Terms of use
Draft for solicitor review (T2-launchability ruling Q7). Version 0.1, 2026-10-15.
These terms are the agreement between you and us for using defry. Please read them, together with our privacy notice, which explains what defry keeps about you.
Who provides defry
defry is provided by WhaleyBear Ltd, a company registered in England and Wales, company number 16254997, registered office Document Studios, 30 Pennywell Road, Bristol BS5 0TH. “We” and “us” mean WhaleyBear Ltd. You can reach us at support@defry.ai, and our other details are on the contact page.
Who can use defry
You must be 18 or over and live in the UK. defry is in testing and is offered only to people we invite, in the UK.
What defry is
defry is an Android app that helps you put your phone down, especially at night. You write rules in your own words. defry watches which app is open, and when a rule says so, it steps in: it puts a screen in front of you, asks you something, or talks with you. An AI judge decides, moment by moment, whether a rule applies.
What defry is not
- defry is not medical advice or treatment. It is not a doctor, a therapist or a medical device, and it does not diagnose or treat any condition. If you are worried about your health, sleep or mood, talk to your GP or another health professional.
- defry is not a crisis service. It cannot call for help, and no one at defry watches your conversations as they
happen. If you are in danger, or thinking about harming yourself, get help now:
- call 999, or go to A&E, in an emergency;
- call Samaritans free on 116 123, any time, day or night;
- text SHOUT to 85258 for free, confidential support by text, any time;
- in England, call NHS 111 and choose the mental health option;
- in Scotland, call NHS 24 on 111 and choose the mental health option;
- in Wales, call NHS 111 and press 2 for urgent mental health support, any time;
- in Northern Ireland, call Lifeline free on 0808 808 8000, any time.
The limits of AI
defry uses AI to judge when to step in and to talk with you. AI can be wrong. It can misread a moment, step in when you did not need it, miss a moment when you did, or say something unhelpful or untrue. defry’s AI is not a person, and what it says is not professional advice. Please use your own judgement, and tell us when it gets things wrong: there is a bug in the corner of the app for that.
You stay in control
defry is built with these safeguards:
- Pause stops all step-ins for an hour;
- if defry crashes three times within ten minutes, it stops stepping in until you turn it back on;
- defry is built never to step in on the phone, emergency or text message apps it knows, or while you are on a call.
We test these carefully, but no software is perfect. If defry ever gets in the way of something urgent, you can also turn off its permissions in Android’s settings or uninstall it.
Trying defry, signing up and access codes
- Trial. When you first install defry, you get a free trial of 7 days from first use, without signing up. During the trial defry can step in using its starter rules. Conversations need you to sign up or use a code.
- Signing up. Sign up with Google or with an email address and password. Keep your sign-in details safe: you are responsible for what happens on your account.
- Access codes. We may give you a code that gives you full access without signing up. Each code can be used a set number of times, and each person can use a code once. It gives access for a set length of time, or with no end date, as we tell you when we give it. The access a code gives belongs to the account that used it: you cannot pass it on. A code has no cash value and cannot be exchanged for money. We can end a code, and the access it gave, if it is misused or shared, or when testing ends. When access ends, you can sign up to carry on.
Paying
defry is free while it is in testing. If we later offer paid plans, they will come with their own terms, which we will show you before you are asked to pay anything.
Using defry fairly
Please do not:
- try to get into anyone else’s account or data, or into defry’s servers;
- share, sell or publish access codes;
- try to overload, copy, take apart or misuse defry or its AI, or use it to make harmful or unlawful content;
- use defry on a phone that is not yours, or to watch someone else’s phone use.
Ending your account
You can stop using defry at any time and delete your account in the app (Settings, Delete my account), at account.staging.defry.ai, or by emailing privacy@defry.ai. The privacy notice says what is deleted and what is kept.
We may suspend or end your access if you break these terms, if we have to by law, or when testing ends. Unless there is a good reason not to, we will tell you first.
Changes to defry and to these terms
defry is in testing, so it will change, and features may come and go. If we change these terms, we will tell you in the app before the change applies. If you do not agree, you can stop using defry and delete your account.
Our responsibility to you
We provide defry with reasonable care and skill. Nothing in these terms limits your legal rights as a consumer, or our responsibility for death or personal injury caused by our negligence, or for fraud.
Beyond that, because defry is free and in testing, it is provided as it is: we do not promise that it will always work, always step in at the right moment, or be available without interruption. We are not responsible for losses that were not foreseeable when you started using defry, or for any business losses.
The law
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in the courts where you live, and the mandatory consumer protections of that law still apply.
